What is a Deferred Judgment?

A deferred judgment is when you plead guilty to a criminal charge, but the court delays entering a conviction. Instead, you're placed on probation. If you successfully complete probation, the court dismisses the charge and no conviction is entered on your record.

Even though dismissed, the case still shows up on background checks. That's where expungement comes in—it seals the record from public view.

Successfully completed deferred judgment
You must have completed all probation terms and the case was dismissed
Paid all financial obligations
All fines, fees, court costs, and restitution must be paid in full
180 days have passed (for pre-2013 cases)
If you completed probation before July 1, 2013, you must wait 180 days before filing
No new criminal charges
You cannot have pending criminal charges

What's the difference between pre-2013 and post-2013 deferred judgments? +
Before July 1, 2013, you had to file a petition to expunge. After July 1, 2013, expungement is automatic once you complete probation and pay all obligations. However, many people still need help verifying expungement and ensuring records are properly removed from all databases.
Will the case completely disappear? +
The case is sealed from public view, meaning it won't show up on Iowa Courts Online or most background checks. Courts, prosecutors, and law enforcement can still see it, but for employment and housing purposes, you can legally answer "no" when asked if you've been convicted.
Do I have to go to court? +
Usually not. Most deferred judgment expungements are granted without a hearing. If a hearing is needed, our attorney appears on your behalf—you typically don't need to attend.
What if the court denies my expungement? +
If your expungement is denied due to an error on our part (wrong information, missed deadline, etc.), we'll refund your attorney fees 100%.
